When it's wise to own up to a bankruptcy

Those who have gone through bankruptcy in South Carolina may be hesitant to disclose this fact to employers. They may think that they will lose a job opportunity or otherwise face discrimination for going through such a process. Employers are generally allowed to look at an applicant's financial history as part of the hiring process. Whether or not the bankruptcy plays a role in the hiring often depends on the job.

For instance, those who may need to be bonded as part of their job may not be able to because of the bankruptcy. If a job involves handling large sums of money, a recent debt problem may call into question a candidate's ability to be trusted with finances. However, it is always better to be honest about previous financial issues when talking with an employer.

While an employer may disqualify someone from consideration because of a bankruptcy, this is not always the case. Most employers, however, will be upset if a job candidate is dishonest about such a situation. Lies could get an applicant into more trouble than actually going through bankruptcy, which is why individuals are encouraged to own up to their bankruptcy and learn from their mistakes.

Bankruptcy may be an effective way to overcome past financial challenges and get a fresh financial start. Chapter 7 or 13 bankruptcy may help individuals or business owners eliminate or reorganize their debts. Bankruptcy may also be helpful for those looking to postpone a foreclosure or repossession as a stay may be granted against creditor actions. This might allow time to negotiate new loan terms or settle a debt without litigation.
